By creating an account or using this HR management platform ("the Service"), the organisation registering ("Client", "you") agrees to be bound by these Terms of Service, which are governed by the Laws of Kenya.
We provide a subscription-based HR management platform covering attendance, leave, timesheets, payroll, performance management, and related modules, as described on our Pricing page.
New organisations receive a free trial period as stated at sign-up. After the trial ends, continued access requires payment of the applicable subscription fee, quoted in Kenya Shillings (KES), for each billing period. We reserve the right to change pricing with reasonable notice to the Client.
You are responsible for the accuracy of data entered into the Service, for keeping login credentials secure, and for ensuring your use of the Service complies with applicable Kenyan law, including the Employment Act, 2007 (including its record-keeping requirements for employee files), the Data Protection Act, 2019, and applicable tax and statutory-deduction obligations to the Kenya Revenue Authority, the National Social Security Fund (NSSF), and the Social Health Authority (SHA).
As between the Client and us, the Client is the data controller of the employee personal data it enters into the Service, and we act as its data processor, processing that data only on the Client's documented instructions and for the purpose of providing the Service, in accordance with our Privacy Policy and the Data Protection Act, 2019.
You agree not to misuse the Service, including attempting to gain unauthorised access to other organisations' data, disrupting the platform, introducing malicious code, or using it for any unlawful purpose. Such conduct may also constitute an offence under the Computer Misuse and Cybercrimes Act, 2018.
You retain ownership of the data you and your employees enter into the Service. We claim no ownership rights over Client data and will not use it for purposes outside providing and improving the Service, except as disclosed in our Privacy Policy.
The Service, including its software, design, and underlying technology, is our property or that of our licensors, and is protected under the Copyright Act, 2001, and other applicable Kenyan intellectual property law. Nothing in these Terms transfers ownership of the Service to the Client.
Subscription fees are payable in advance for each billing period through the payment channels made available on the platform. Late or failed payment may result in suspension of access, subject to any notice period stated at checkout or in your invoice.
We may suspend or terminate access for non-payment, breach of these Terms, or as otherwise required by law. You may stop using the Service, and close your account, at any time. On termination, Client data will be made available for export or deleted in line with our Privacy Policy and any statutory retention obligations.
The Service is provided on an "as is" and "as available" basis. While we take reasonable steps to keep the Service accurate and available, we do not warrant that it will be uninterrupted or error-free, and we do not provide tax, legal, or accounting advice — Clients remain responsible for the correctness of statutory filings made using data from the Service.
To the extent permitted under the Laws of Kenya, we are not liable for indirect, incidental, or consequential losses arising from use of the Service. Nothing in these Terms limits liability that cannot lawfully be excluded, including liability arising from fraud or wilful misconduct.
Nothing in these Terms is intended to exclude or limit any right the Client may have under the Consumer Protection Act, 2012, to the extent it applies to the Client's use of the Service.
These Terms are governed by the Laws of Kenya. The parties will first attempt to resolve any dispute through good-faith negotiation. Unresolved disputes shall be subject to arbitration under the Arbitration Act, 1995, seated in Nairobi, or, at either party's election, the exclusive jurisdiction of the courts of Kenya.
We may update these Terms from time to time. The "Last updated" date at the top of this page shows when it was last revised. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
